TERMS AND CONDITIONS FOR THE USE OF THE VESSEL BY THE USER
VESSEL USE POLICIES
The client acknowledges and agrees that they are fully responsible for the use of the vessel, as well as for complying with all terms and conditions established herein.
The Client acknowledges that, at all times during the charter, the Captain of the Vessel shall have final authority and full discretion to make decisions regarding the safety and operation of the vessel, including terminating the trip if, in their judgment, the safety of the crew, passengers, or vessel is at risk.
The Client and all passengers agree to follow the instructions of the Captain and crew at all times.
The duration of the vessel use shall be strictly limited to the time specified on the BOATY platform.
Minors must always be accompanied and supervised by an adult.
Smoking on board is strictly prohibited.
Diving, jumping, throwing objects into the sea, handling navigation instruments, or engaging in any similar activity is prohibited. Diving may only be permitted when the vessel is stationary and with prior authorization from the Captain. The Captain and BOATY shall not be liable for accidents resulting from such physical activities.
Responsible alcohol consumption is the sole responsibility of the Client. Excessive or inappropriate alcohol consumption may result in the immediate termination of the charter without refund.
The use or possession of illegal substances and weapons on board is strictly prohibited.
The Client agrees to use the vessel responsibly and to cover the cost of any damage, breakage, theft, loss, or misuse caused to the vessel or any accessories listed in the vessel inventory due to negligence or improper use. The Client expressly releases BOATY from any liability arising from such situations.
The Client agrees to return the vessel in the same condition in which it was delivered. At the conclusion of the charter, both parties shall inspect the vessel and jointly review the inventory. The Captain shall document any damages, if applicable. In the event of damages, the Client authorizes BOATY to charge the credit card used during the reservation process to cover such damages.
BOATY shall not be responsible for any loss, theft, or damage to passengers’ personal belongings during the charter period.
BOATY shall not be liable for injuries, personal harm, or material damages resulting from accidents related to diving, swimming, water skiing, wakeboarding, jet skiing, or any other nautical activity or water sport carried out during the use of the vessel.
RESERVATION AND PAYMENT POLICIES
The Client agrees to comply with the following reservation and payment policies for the use of the vessel.
The Client acknowledges and agrees that BOATY is not the owner of any vessel. BOATY acts solely as a platform and intermediary facilitating the charter of vessels directly offered by their respective owners, who have previously registered their vessels on the BOATY platform.
Payments must be made through the authorized payment methods available on the BOATY platform. The Client acknowledges that transactions are subject to third-party payment processors, banking institutions, and payment gateways that operate independently from BOATY. Therefore, BOATY shall not be responsible for failures, delays, or issues related to such systems, and the Client expressly releases BOATY from any liability or dispute arising between the Client and such financial institutions or payment processors.
The rates applicable to each vessel shall be those published on the BOATY website and/or official BOATY communication channels. Any rates different from those officially published by BOATY shall not be considered valid.
CANCELLATION POLICIES
The Client acknowledges and agrees to comply with the following cancellation policies regarding the use of the vessel. BOATY reserves the right to cancel reservations with refund eligibility under the following circumstances:
Technical problems affecting the vessel that prevent the charter from starting or safely continuing.
Extreme weather conditions that directly compromise the safety of passengers or the vessel. Weather-related cancellations may only be determined by BOATY and not by the Client. Situations such as rain, cloudy skies, ordinary wind, or unfavorable weather conditions shall not constitute valid reasons for cancellation by the Client.
Any circumstance that, in BOATY’s sole judgment, compromises the proper operation of the service or the safety of passengers or the vessel.
In the above cases, BOATY shall have a maximum period of 5 to 10 business days to process the applicable refund. BOATY shall not be held responsible for delays caused by banking institutions or payment processors.
The Client may cancel the service after payment of the charter fee under the following conditions:
✔ 100% refund — cancellations made 15 days or more prior to the scheduled service date.
✔50% refund — cancellations made between 10 and 14 days prior to the scheduled service date.
✖ No refund — cancellations made 9 days or less prior to the scheduled service date.
RELEASE OF LIABILITY
Both the vessel owner and the Client acknowledge and agree that BOATY solely provides promotional and brokerage services for vessel charters. Accordingly, BOATY’s responsibility is strictly limited to the obligations expressly stated in these Terms and Conditions.
The Client expressly releases BOATY from any liability related to accidents, incidents, injuries, passenger death, damages to third parties, damages to the vessel, negligence by the Captain, violations of maritime regulations, environmental or marine wildlife damage, or any other event arising from the improper use of the vessel or failure to comply with these Terms and Conditions by the Client, vessel owner, passengers, or third parties unrelated to BOATY. The Client waives any civil or legal claims against BOATY arising from such events.
The Client confirms that they enter into these Terms and Conditions knowingly, voluntarily, and legally, declaring that they are of legal age and possess the necessary authority and capacity to assume all rights and obligations contained herein.
